Abstract: General law of obligations and (autonomy of) commercial law – This essay, which is dedicated to the one hundred and twentieth anniversary of the “Rivista del diritto commerciale e del diritto generale delle obbligazioni”, deals with the topic of the relationship, at the theoretical and systematic level, between the law of obligations, as a core component of “general” private law, and commercial law as a branch thereof. In particular, having recalled the main steps through which the debate around the scientific autonomy of commercial law has unfolded in the last decades, this essay aims at contributing to the evolution of such debate by delving into the complex relationship between the performance of obligations undertaken by a firm and the organization of the firm itself, also to the purposes of the ascertainment of the firm’s liability.
